An article in the Telegraph says that because Twattenburg saw it, the FA can't take retrospective action.

Not seen it myself, but refs have gone pretty anal about elbows in the past 12 months or so, look at Viera's in that friendly against Inter, was nothing in it.

Looking at the replay, i don't think Clattenberg saw it, there was just no need for it, shithouse scouse thug.

There is a precedent with Ben Thatcher when he assaulted Pedro Mendes

He must have done to award the free kick for the tackle. He then came out and said after the game he didnt realise how serious Ade's "asault" had been and thats why he was charged.

There's nothing about it on the BBC website despite the fact it was highlighted on MOTD and was also the main talking point surrounding yesterday's football.

Clattenburg is the biggest problem, I think he is a cheat and a glory hunter.

Clattenburg gave a free-kick to Wigan and had a word with Shrek, so he must have seen it. Rooney will get banned by the FA when they review it and hopefully Clattenburg will be sent to the blue square league or somewhere similar for the rest of his career.
